1. Scope & Acceptance

These Commission Terms of Service apply exclusively to custom digital art commissions offered by The Inked Fennec.

They do not apply to tattoo services, physical shop products, appointments or other products and services offered through this website.

Submitting a commission request does not automatically guarantee acceptance. I reserve the right to accept or decline any request.

A commission is considered accepted once the scope, final price and commission details have been confirmed and the required initial payment has been received.

2. Prices & Currency

All prices are stated in EUR (€) unless otherwise agreed.

Prices displayed on the commission page are base prices. Additional fees may apply depending on size, complexity, additional characters, variants, backgrounds, rush requests, privacy requirements or commercial use.

The final price will always be communicated before the commission is accepted.

Current additional fees include:

• A1 Poster — +€25
• Desktop / 4K Wallpaper — +€25
• Dakimakura / Body Pillow — +€45
• Additional Topless / Nude Variant — +€30
• Additional Character — +75%
• Rush Commission — +50%
• Private Commission / Do Not Post — +20%
• Detailed / Complex Background — Custom Quote
• Commercial Use — Custom Quote

Prices and fees may be updated for future commissions. An accepted commission will not be retroactively changed simply because the public price list is later updated.

3. Payment — Rough Sketch

Rough Sketch commissions require 100% payment upfront.

Work begins only after the full payment has been received.

The completed Rough Sketch is the final deliverable for this commission type.

4. Payment — Line-Art, Flat Colors & Full Render

Clean Line-Art, Flat Colors and Full Render commissions require a 50% deposit before work begins.

After receiving the initial payment, I will create a rough sketch for review.

Once the rough sketch has been approved, the remaining 50% balance becomes due.

I will continue with line-art, coloring or rendering only after the remaining balance has been received in full.

5. Rough Sketch Approval & Revisions

The rough sketch stage is used to establish the pose, composition, expression and overall direction of the artwork.

Up to three minor revisions are included during the rough sketch stage at no additional charge.

Minor revisions may include:

• small pose adjustments
• facial expression changes
• minor anatomy corrections
• small hairstyle changes
• small clothing or accessory adjustments

Major changes such as a completely different pose, composition, outfit, character concept or overall direction may require an additional fee.

Once the rough sketch has been approved, the main pose, composition and design direction are considered final.

Approval must be given in writing, for example by email or another agreed communication method.

6. Changes After Sketch Approval

Minor corrections may still be possible after sketch approval if they do not require substantial redrawing or repainting.

Major changes requested after approval may result in an additional fee, increased turnaround time, or may be declined.

If I have made a clear mistake that differs from the approved sketch or agreed reference material, I will correct it without an additional fee.

7. Artwork Types & Character Framing

Available commission types may include:

• Rough Sketch
• Clean Line-Art
• Flat Colors
• Full Render

Available character framing may include:

• Chibi
• Headshot / Bust-Up
• Half Body
• Full Body

The selected commission type and character framing determine the base price.

8. Additional Characters

Each additional character is currently charged at +75% of the relevant commission price.

Highly complex character interactions, overlapping poses or unusual compositions may require an individual quote.

9. Additional Topless / Nude Variants

Additional Topless or Nude Variants are available for Full Render commissions only.

The current fee is +€30.

The additional version uses the same general pose and composition as the original finished illustration, with clothing altered or removed.

It is not considered a completely separate illustration unless the requested variation requires substantial changes to the pose, anatomy, composition or overall design.

10. Artwork Size & Resolution

Available artwork sizes and formats are listed on the commission page.

Standard and smaller formats may be included in the base price. Larger or technically demanding formats may require an additional fee.

Custom or unusually large formats will be quoted individually.

11. Dakimakura / Body Pillow Artwork

A Dakimakura commission refers to the digital artwork intended for printing.

Unless explicitly agreed otherwise, I do not manufacture, print or ship physical Dakimakura covers, pillows or other products.

The client should provide the print manufacturer's template, dimensions, safe areas, bleed requirements and other technical specifications where available.

Front and back artwork requiring two substantially different illustrations may require additional fees.

12. Color Mode & Printing

Artwork may be prepared in RGB or CMYK depending on the intended use.

• RGB is generally recommended for digital use.
• CMYK may be used for print-oriented artwork where appropriate.

Colors may appear differently depending on monitor calibration, printing method, material, inks, printer settings and color profiles.

I cannot guarantee an exact match between the digital artwork and a physical print produced by a third party.

13. Backgrounds

Transparent, white, matching color, gradient and other simple backgrounds may be included where stated on the commission page.

Detailed or complex backgrounds require an individual quote and are accepted on a case-by-case basis.

Highly detailed environmental artwork is not my primary specialty and may be declined.

14. Rush Commissions

Rush commissions may be available depending on my current schedule.

The current Rush Commission fee is +50%.

A requested deadline is not automatically accepted simply because it was entered into the commission form.

A deadline is considered agreed only after I have explicitly confirmed it.

15. Private Commissions

Unless otherwise agreed, I may display completed commissioned artwork on my website, portfolio and social media.

If the client requires the artwork to remain completely private and does not want it publicly posted, the current fee is +20%.

This arrangement must be agreed before work begins.

The client may alternatively request anonymous publication, where the artwork may be displayed without identifying or tagging the commissioner.

16. Personal Use

Standard commission prices include a personal-use licence unless otherwise agreed.

Personal use may include:

• personal profile pictures
• personal banners
• wallpapers
• personal social media posts
• private prints
• personal device backgrounds

Personal-use commissions may not be commercially exploited.

17. Commercial Use

Commercial use is not included in the standard commission price.

Commercial use requires a separate licence and an individual quote.

Commercial use may include:

• merchandise
• products for resale
• advertising
• commercial branding
• monetized publications
• paid promotional material
• other revenue-generating use

Purchasing a commercial licence does not automatically transfer copyright ownership.

18. Copyright

Unless explicitly agreed otherwise in writing, I retain the copyright to the commissioned artwork.

Purchasing a commission does not transfer copyright ownership.

The client receives only the usage rights expressly granted for the commission.

19. What I Draw

I currently focus primarily on adult female characters.

I may accept:

• SFW artwork
• Suggestive / Lewd artwork
• Explicit NSFW artwork
• Nudity
• Fanart
• Original characters
• Kemonomimi characters
• Animal ears, tails, horns and similar fantasy features
• Simple backgrounds
• Selected gore content

Gore is accepted on a case-by-case basis, as it is not my main specialty.

20. What I Don't Draw

• Sexual or NSFW depictions of minors
• Sexual or NSFW depictions of characters who appear underage
• Full furry / anthro characters
• Mecha
• Highly mechanical designs
• Heavy armor
• Highly detailed backgrounds outside my offered scope

I reserve the right to decline additional subjects or requests that I am uncomfortable creating.

21. NSFW Age Requirements

Clients requesting NSFW content must be at least 18 years old.

All characters depicted in sexual or explicit NSFW artwork must clearly be adults.

I will not create sexualized or NSFW artwork depicting minors or characters who appear underage, regardless of their fictional, stated or canonical age.

22. References & Client Instructions

Clear visual references should be provided whenever possible.

Important information should be communicated before work begins, including character appearance, pose, expression, outfit, mood, composition, accessories and relevant NSFW details.

If important information is provided only after the rough sketch has been approved, changes resulting from that information may require an additional fee.

The client is responsible for checking the rough sketch carefully before approving it.

23. Reference Material & Third-Party Rights

The client is responsible for ensuring that they are permitted to provide any private or restricted reference material submitted with the commission.

Commissioning fanart does not grant ownership of the underlying character, franchise, trademark or other third-party intellectual property.

A commercial licence from me cannot grant rights that belong to another copyright or trademark owner.

24. Original Character Design

Standard illustration prices assume an existing character design or sufficiently clear reference material.

If substantial original design work is required, such as creating clothing, hairstyles, accessories, colors or other major design elements, an additional character-design fee may apply.

25. Turnaround Time

Any turnaround time provided is an estimate unless a specific deadline has been explicitly agreed in writing.

Completion time may vary depending on:

• commission complexity
• artwork size
• current workload
• revision requests
• client response time
• payment delays
• technical requirements

Large-format and Dakimakura commissions may require additional time.

26. Client Response & Inactivity

The client is responsible for providing valid contact information and responding to requests for feedback, approval, payment, references or additional information.

Work may be paused while I am waiting for the client.

Time spent waiting for client feedback or payment is not included in estimated turnaround times.

If the client does not respond for 30 days, I may archive the commission.

An archived commission may be resumed later depending on my availability.

27. Cancellation by the Client

If the client wishes to cancel a commission, they should contact me as soon as possible.

Any refund will depend on the amount of work already completed and any mandatory statutory rights that apply.

Payments relating to work already performed are not automatically refundable simply because the client changes their mind.

Mandatory consumer rights remain unaffected.

28. Cancellation by the Artist

I may cancel a commission if:

• I become unable to complete the artwork
• required payments are not made
• the client repeatedly violates agreed boundaries
• the client behaves abusively or threateningly
• the request develops into work substantially different from what was agreed

If I cancel for reasons that are not caused by the client's breach of the agreement, payments relating to work that has not yet been completed will be refunded.

29. Statutory Withdrawal Rights

Nothing in these Commission Terms limits mandatory statutory consumer rights.

Where a statutory right of withdrawal applies, the applicable statutory rules remain unaffected.

Where applicable, eligible consumers generally have a statutory withdrawal period of 14 days.

If the client expressly requests that commission work begins before the end of an applicable withdrawal period, statutory rules regarding payment for services already performed may apply if the client later exercises the right of withdrawal.

Separate statutory withdrawal information may be provided where required.

30. Digital Delivery

Commissions are delivered digitally.

Unless otherwise agreed, final delivery consists of a flattened high-resolution image file such as PNG or JPG.

No physical product is included unless explicitly agreed otherwise.

31. Source & Working Files

Layered source files and editable working files such as PSD, CSP, SAI or equivalent files are not included in the standard commission price.

Sketches, discarded concepts, intermediate files, layer structures and other production materials are not part of the final deliverables unless explicitly agreed otherwise.

32. File Retention

Clients should download and safely store their final artwork after delivery.

I may retain project files for backup purposes, but I cannot guarantee indefinite storage or future replacement of lost files.

33. Editing the Artwork

The client may resize or crop the artwork for ordinary permitted use.

The client may not substantially redraw, repaint or alter the artwork and then present the altered version as my original work.

The client may not claim authorship of the commissioned artwork.

34. AI & Machine Learning

Commissioned artwork may not be used to train, fine-tune, develop or supply datasets for generative AI, machine-learning models or similar automated image-generation systems without my explicit prior written permission.

The artwork may not intentionally be uploaded to a service for the purpose of creating a trainable model based on my artwork or artistic style.

35. NFTs & Blockchain Use

Commissioned artwork may not be minted, tokenized, sold or otherwise used as an NFT, cryptocurrency-related asset or blockchain-based digital collectible without my explicit prior written permission.

36. Resale & Redistribution

The client may not:

• resell the original digital artwork file
• redistribute high-resolution files as downloadable assets
• sell the artwork as stock imagery
• make the original files available for third-party reuse

Exceptions require an explicit written licence.

37. Payment Disputes & Chargebacks

If there is a problem with a commission, the client should contact me first so that the issue can be discussed.

In the event of a payment dispute or chargeback, I may provide relevant records to the payment provider, including invoices, correspondence, proof of work completed and proof of delivery.

Nothing in this section limits legitimate statutory rights or rights available through a payment provider.

38. Client Conduct

Communication must remain respectful.

Harassment, threats, discriminatory abuse, repeated sexual harassment directed at me personally, or repeated attempts to pressure me into creating content I have declined may result in cancellation of the commission.

39. Privacy & Personal Information

Personal information submitted for a commission may include name, billing address, email address, commission details and reference material.

This information may be used as necessary to:

• handle the commission request
• communicate with the client
• prepare invoices
• complete the commission
• meet applicable legal and accounting obligations

40. Changes to These Terms

These Commission Terms may be updated for future commissions.

Changes made after a commission has already been accepted do not automatically replace the version that applied when that commission was accepted.

41. Final Provision

If an individual provision of these Commission Terms is invalid or unenforceable, this does not automatically affect the remaining provisions to the extent permitted by applicable law.

Mandatory statutory consumer rights remain unaffected.
